EU AI Act Article 49: registering in the EU database

Article 49 requires the provider (or authorised representative) of a high-risk AI system to register itself and the system in the EU database referred to in Article 71, before placing the system on the market or putting it into service, using the information set out in Annex VIII. Providers who conclude, per Article 6(3), that their system is not actually high-risk must still register that assessment. Deployers that are public authorities or bodies must register their use of a high-risk system before putting it into use, under Annex VIII Section C. Certain law-enforcement, migration, and asylum uses are registered in a non-public, secure section of the database instead.

Who it applies to

Providers of Annex III high-risk systems from the point the relevant deadline applies, and public-sector deployers separately. Private-sector deployers are not generally required to register under Article 49, though they carry their own obligations under Article 26.

What evidence this implies

A registration entry is a snapshot: system identity, provider identity, intended purpose, and status. It is not evidence that the system behaves as registered on any given day. Authorities checking a registered system will typically want to see it matches, in practice, what the entry describes.

Gaps to state honestly

The database entry does not require, and does not contain, run-level logs. A registration can be accurate on the day it's filed and stale a year later if the system's purpose or configuration drifts without anyone updating the entry.

How Vetro helps

Vetro does not file your registration. It provides the ongoing, verifiable record — a hash-chained, ed25519-signed ledger of every model call, tool call, and policy decision — that lets you or an auditor confirm the deployed system still matches what was registered. Vetro Attest verifies a ledger or OTLP GenAI trace for free and, for 29 USD, issues a counter-signed report mapping that evidence to the EU AI Act. This is technical evidence, not legal advice.
