EU AI Act Article 8: how compliance with Chapter III is judged
Article 8 is the hinge for the whole set of high-risk requirements: it states that high-risk AI systems must comply with the requirements set out in Chapter III, Section 2 — risk management (Article 9), data governance (Article 10), technical documentation (Article 11), logging (Article 12), transparency (Article 13), human oversight (Article 14), and accuracy, robustness, and cybersecurity (Article 15). Compliance is assessed taking into account the system's intended purpose and the generally acknowledged state of the art, including relevant harmonised standards or common specifications. Where a high-risk AI system is also covered by other EU harmonisation legislation, the provider must ensure compliance with all applicable sets of requirements.
Who it applies to
Providers of high-risk AI systems under Article 6, and it functions as the reference point every other Chapter III article is measured against — an auditor invoking "Article 8" is usually really asking whether Articles 9 through 15 are satisfied together, as a system.
What evidence this implies
Because Article 8 frames compliance as a whole-system judgment rather than a single checklist item, the supporting evidence is necessarily the sum of the other Chapter III articles: risk records, data governance documentation, technical files, logs, transparency information, oversight records, and accuracy/robustness testing, all pointing to the same system version and intended purpose.
Gaps to state honestly
"State of the art" and "intended purpose" are not fixed — they shift as models are updated, fine-tuned, or repurposed, and Article 8 does not specify how often compliance should be re-checked. A one-time assessment can go stale quietly if nothing tracks what changed afterward.
How Vetro helps
Vetro does not certify Chapter III compliance. It gives you the run-level record — a hash-chained, ed25519-signed ledger of model calls, tool calls, and policy decisions — that shows what the system's intended purpose and configuration actually were on any given day, so a compliance judgment under Article 8 can be re-checked against reality rather than assumed to still hold. Vetro Attest verifies a ledger or OTLP GenAI trace for free and, for 29 USD, issues a counter-signed report mapping that evidence to the EU AI Act. This is technical evidence, not legal advice.
